Asset deal: beware of VAT!
Given the post-confinement economic situation, it is highly likely that there will be an increase in the number of total or partial business disposals. A judgment of the Federal Court of 21 February 2020 (2C_923/2018) shows that there are VAT risks not only when taking over a whole company, but also in the case of a partial takeover (transfer of assets and liabilities).
